If you have been left a gift in a will or are benefiting in an estate but wish to redirect this legacy to someone else perhaps another member of your family a deed of variation is a tax effecient means of actioning this. If you onward gift your legacy and yourself die within seven years of doing so your estate could pay additional inheritance tax. If a deed of variation of the deceased's estate is made following the statutory rules this potential problem is avoided.
What we do:
We can prepare deeds of variation to specifically confirm to the legislative requirements to ensure that you are not exposed to future inheritance tax on any onwards gifts or redirections you chose to make. Deeds of variation can also assist with capital gains tax planning. We can advise you on the implication of such tax planning, ensure that time constraints are met and that any reporting to HMRC is done on your behalf.
