Commercial disputes led by emotion

Solicitors in Northern Ireland may see clients involved in commercial disputes become as bitter as some of the divorce clients they have seen, after new research reveals that around half of litigation battles are caused by personal conflict.

According to a poll conducted by Field Fisher, 47 per cent of executives admitted that they had started legal proceedings due to a personal dislike of the other party.

However, despite the fact that bosses confessed to letting their emotions overcome them in commercial disputes, solicitors in Belfast could see shorter cases from city executives as it seems that firms acknowledge that the practice of escalation is sometimes not as favourable as negotiation.

A massive 97 per cent agreed that the business community often did not realise how much time and money can be lost if a commercial dispute reaches the courts. A further 88 per cent said that unrealistic expectations were an obstruction to the resolution of the matter in many cases.

Due to these facts, every single person polled agreed that alternative methods of dispute resolution were extremely important, highlighting the fact that out-of-court negotiations and settlements made through solicitors could cut down on time and costs.

Field Fisher commercial litigation chief Peter Stewart commented: "One of the major factors contributing to the escalation of disputes is the emotion involved. Whether it's personal pride, dislike of the other side or a point of principle, these emotions will inevitably distract from rational decision-making."
