Consult solicitors in NI for civil partnership 'divorce'

25/06/2008
The laws governing dissolution - or 'divorce' - in a civil partnership are not quite the same as those for married couples and as such it is essential to consult a solicitor when considering such a move in Northern Ireland, the Law Society has said.

Unlike for married couples, adultery is not considered grounds for dissolution for couples in a civil partnership.

In order to dissolve the agreement, parties must have been joined for more than a year and one of the four further categories must apply.

These are unreasonable behaviour by one of the parties, having lived apart for two years with both parties' consent, having lived apart for five years when one does not consent or having been deserted by one party for two years prior to the application.

Northern Ireland civil partnership couples considering separating should also visit a solicitor to rearrange their will and inheritance, the Law Society has advised.

The number of civil partnerships taking place in the UK fell by 46 per cent in 2007 to 8,728 and in Northern Ireland the number fell by four per cent to 111, according to figures from the Office for National Statistics.
