'No fault' divorces mooted
Solicitors in the UK are calling for the development of no fault liability in divorce cases.
A lawyers' group has suggested that a 'no fault' divorce system should be introduced into the UK system as part of a radical overhaul of the family law regime.
Jane McCulloch, group chairman of Resolution - the organisation behind the suggestions - has claimed that introducing a no fault system to divorce cases would the "blame culture" that currently exists in family law.
"Under current law, anyone wanting an immediate divorce has to prove 'unreasonable behaviour' or adultery on the part of their husband or wife," she explained.
"This blame culture of unreasonable behaviour introduces a degree of discord and unpleasantness into divorce proceedings from their very inception."
The move would have huge consequences for solicitors in the UK and Northern Ireland, radically changing the approach to divorce proceedings.
No fault divorces were considered by the government as part of the Family Law Act 1996, but were eventually written out of the final version.
