Law Commission to review charity legislation
The Law Commission has announced plans to conduct a review of charity legislation, to begin toward the end of 2012 when Lord Hodgson has completed his review of the Charities Act.
The Charity Law Association (CLA) will focus on legal solutions to some of the complicated issues currently found in charity law, with the topics falling into one of the following categories:
1) Controversial
2) Important but difficult to implement
3) Easy wins
4) Issues requiring clarification
Nicola Evans advised that the longest list is the 'controversial category', which includes issues such as the definition of charity, public charitable collections, the Charity Commission, the Charity Tribunal, and political activity. She went on to explain that the goals and timeframe of the review is to have a draft bill in 2014 that leads to an Act, perhaps in 2018.
