A transfer occurs when a licence is transferred from one person to another. Applications for transfers are heard by the local Magistrates Court. The Court must be satisfied that the person who is applying to hold the licence is a fit and proper person and is or will become the owner of the business selling intoxicating liquor by retail. In addition the applicant must establish that the business authorised by the licence has not been discontinued. It will often be the case that the applicant has been carrying on the licensed business under a protection order prior to the application for the trnasfer. Notices for transfers have to be served on the local authority and most importantly the police. Appropriate advertisements must be placed in local newspapers and strict statutory requirements must be adherred to under the legislation. Although objections may be raised by interested parties, the Court will usually be happy to grant a transfer as long as the police do not object.
